Introduction

AccuAligners values the privacy of all users who visit its website. This policy explains how personal data is handled when collected through your website usage. Data will be processed in accordance with applicable legal data protection regulations.

Definitions

This policy aims for simplicity and clarity. The official terms of the General Data Protection Regulation (GDPR) are used throughout. Definitions can be found in Article 4 GDPR.

Web Hosting

AccuAligners’ website is hosted by an external service provider (hoster) located in usa. Any personal data collected on the website is stored on the hoster’s servers. This could include:

  • IP addresses
  • Contact requests
  • Meta and communication data
  • Web page access data
  • Other data generated by the website. 

AccuAligners will have a Data Processing Agreement with the provider, meeting the requirements of Art. 28 GDPR. This agreement ensures the provider protects customer data and does not share it with third parties.  

Server Log Files

When visiting AccuAligners’ website, it is technically necessary for your internet browser to send data to the web server. While an active connection is in place for communication between your browser and the web server, the following data is recorded:

  • Date and time of the request
  • Name of the requested file
  • Page the file was requested from
  • Access status
  • Web browser and operating system used
  • Full IP address of the requesting computer
  • Amount of data transferred 

AccuAligners collects this data to:

  • Guarantee a smooth connection
  • Provide users with a comfortable website experience
  • Evaluate system security and stability
  • Perform administrative tasks.

For technical security reasons and to prevent server attacks, AccuAligners may temporarily store this data. However, AccuAligners cannot use this information to identify individuals. After 30 days at the latest, the data is anonymized by shortening the IP address, making it impossible to identify an individual user. Anonymized data is only evaluated for statistical purposes. This information will not be combined with data from any other sources. 

Cookies

AccuAligners’ website uses “cookies,” which are small text files stored on your device either temporarily (session cookies) or permanently (permanent cookies).

  • Session cookies are automatically deleted when you close your browser.
  • Permanent cookies remain on your device until deleted manually or automatically by your web browser.

Cookies have several functions, many of which are technically necessary for the website to function properly (e.g., shopping cart or language settings). Other cookies are used to evaluate user behavior or display advertising.

AccuAligners stores technically necessary cookies based on Art. 6 para. 1 lit. f GDPR. AccuAligners has a legitimate interest in storing these cookies to ensure error-free and optimized presentation of website services. All other cookies are only stored with your explicit consent, based on Art. 6 para. 1 lit. a GDPR. You can withdraw consent at any time. The legal basis for cookie storage might also stem from Art. 6 para. 1 lit. b GDPR if it’s necessary to fulfill a contractual agreement or implement pre-contractual measures requested by the data subject.  

If cookies are used for analytical purposes, AccuAligners will separately inform you in this policy and seek your consent. 

You can configure your web browser to:

  • Inform you about cookie placement
  • Allow cookies on a case-by-case basis
  • Exclude cookie acceptance in certain or all situations
  • Automatically delete cookies when the browser closes.

Many web browsers offer a “do-not-track” function. Enabling this tells ad networks, websites, and apps that you do not want to be tracked for targeted advertising purposes. To manage this feature in your browser, see:

You can prevent websites from loading scripts by default. Tools like “NoScript” allow JavaScript, Java, and other plug-in execution only from trusted domains you choose. To manage this feature, get instructions from your browser provider.

Change Cookie Settings

Change or revoke your cookie settings at any time using the integrated thumbprint at the bottom left of AccuAligners’ website.

Contact Form and Email

Information from contact forms or emails, including your contact information, will be stored by AccuAligners to process your requests and for follow-up questions. Providing an email address and name are required to contact AccuAligners. This data will not be shared without consent. The legal basis for processing this data is AccuAligners’ legitimate interest in responding to your requests (Art. 6 para. 1 lit. f GDPR) and, if applicable, Art. 6 para. 1 lit. b GDPR, if your request aims to conclude a contract. Your data will be deleted once your request has been completely addressed, unless legal storage obligations prevent this. You can object to data processing at any time in cases of Art. 6 para. 1 lit. f GDPR.  

Registration for an AccuAligners Account

AccuAligners may offer registration for certain website services and allow the creation of a user profile. The following data may be collected during registration and setup:

  • First name, last name, title
  • Email address
  • Mobile number
  • Country
  • Company website
  • Billing information (company name, address, contact person name and email, VAT)
  • Date and time of registration 

Mandatory data for registration will be clearly marked as required fields. Your user account allows you to use AccuAligners services and log in to access purchased offers. If consent is provided, the legal basis for data processing is Art. 6 para. 1 lit. a GDPR, if the processing is necessary to provide the requested services. Your data will be deleted when you delete your user account, as long as no legal storage obligations exist. You can generally change and/or delete your user account, including provided data, directly in your account settings after logging in or by sending a message to the controller listed in this policy. 

Newsletter

To receive the AccuAligners newsletter, containing regular information about its products and services, your email address is required. Additional data may be requested to personalize the newsletter or to identify you if you wish to exercise your data subject rights. 

AccuAligners uses a double opt-in process for newsletter subscriptions. You will receive an email with a confirmation link after subscribing. Once confirmed, you give consent (in accordance with Art. 6 para. 1 lit. a GDPR) for AccuAligners to use your information for sending the newsletter. 

During newsletter registration, AccuAligners stores the email address you provide, the IP address used during registration, and the date and time of both your registration and confirmation. This allows AccuAligners to track potential misuse. 

Unsubscribe from the newsletter at any time by clicking the link in each newsletter or by emailing the data controller. When unsubscribing, your email address will be immediately deleted from the newsletter list unless you have expressly consented to continued use of the collected data. 

AccuAligners uses a technical service provider to distribute email newsletters. This provider will receive the data provided during newsletter registration. AccuAligners will have a data processing agreement with the service provider to ensure customer data protection and prevent third-party sharing.

AccuAligners’ provider uses the data for newsletter dispatch and statistical evaluation on behalf of AccuAligners. For evaluation purposes, emails may contain web beacons or tracking pixels, which are one-pixel image files stored on AccuAligners’ website. This enables AccuAligners to track:

  • If a newsletter was opened
  • Which links (if any) were clicked.

Conversion tracking may also be used to analyze whether a user took a predefined action (e.g. made a purchase on the website) after clicking a newsletter link. Technical information is also collected, including:

  • Time of access
  • IP address
  • Browser type
  • Operating system. 

This information is collected pseudonymously, so it cannot be directly linked to your other personal data. This data is used exclusively for statistical analysis of newsletter campaigns and to tailor future content to better reflect user interests. This data processing is based on the consent you provide during newsletter registration (Art. 6 para. 1 lit. a GDPR).

To revoke consent to data analysis for statistical purposes, you must unsubscribe from the newsletter.

Data Transfer and Recipients

Your personal data will not be shared with third parties unless:

AccuAligners uses external service providers to deliver certain services. These providers are carefully vetted and contractually obligated to follow AccuAligners’ instructions and are regularly monitored. Data processing agreements, meeting the requirements of Art. 28 GDPR, are established before service providers are commissioned. These agreements primarily concern:

  • Web hosting services
  • Email dispatch
  • IT updates and maintenance 

AccuAligners service providers will not transfer your personal data to third parties.  

Data Security

AccuAligners employs appropriate technical and organizational measures to ensure data is protected according to the risk level outlined in Article 32 GDPR. This takes into account:

  • State-of-the-art security measures
  • Cost of implementation
  • Nature, scope, circumstances, and purposes of processing
  • Varying probability and severity of risk to the rights and freedoms of individuals.  

AccuAligners’ website uses SSL encryption to ensure security and protect confidential information transfer. 

Storage Period

AccuAligners determines the storage period for personal data based on relevant statutory storage periods (e.g. commercial and tax law). Data is routinely deleted after the period expires. If data is required to fulfill a contract, to initiate a contract, or if AccuAligners has a legitimate interest in continued data storage, it will be deleted when it is no longer needed or if you exercise your right of withdrawal or objection. 

Your Rights

You have data subject rights under current data protection law, granting you the following with regards to the controller and how your personal data is processed:

  • Right to Access: You have the right (Art. 15 GDPR) to receive information about the personal data AccuAligners processes about you. You may request information about:
  • The purposes of the processing
  • Categories of personal data concerned
  • The categories of recipients to whom your data has been or will be disclosed
  • Planned storage period
  • Existence of the right to request data correction or deletion, or restriction of data processing, or to object to such processing
  • The existence of a right to lodge a complaint with a supervisory authority
  • The origin of your data (if not collected by AccuAligners)
  • Existence of automated decision-making, including profiling, and meaningful information about the logic involved, as well as the significance and the envisaged consequences 
  • Right to Rectification: You have the right to obtain correction of any inaccurate personal data without undue delay (Art. 16 GDPR)
  • Right to Erasure: You have the right to request deletion of your personal data stored by AccuAligners (Art. 17 GDPR), unless:
  • Processing is needed to exercise the right of freedom of expression and information
  • Processing is needed to comply with legal obligations
  • Processing is needed for public interest reasons
  • Processing is needed to establish, exercise, or defend legal claims 
  • Right to Restriction of Processing: You have the right to request restriction of processing of your personal data (Art. 18 GDPR) if:
  • You contest the accuracy of the data
  • The processing is unlawful, but you oppose erasure
  • AccuAligners no longer requires the data, but you need it for the establishment, exercise, or defense of legal claims
  • You have objected to the processing in accordance with Art. 21 GDPR 
  • Right to Data Portability: You have the right to receive the data you have provided to AccuAligners in a commonly used and machine-readable format (Art. 20 GDPR). You also have the right to transfer that data to another controller.  
  • Right to Withdraw Consent: You have the right to withdraw any provided consent at any time with future effect (Art. 7 para. 3 GDPR).
  • Right to Lodge a Complaint: You have the right to lodge a complaint with a supervisory authority (Art. 77 GDPR). You should direct complaints to the supervisory authority in the Member State where you habitually reside or work.

Necessity of Providing Personal Data

You are not required to provide personal data to obtain a decision on contract conclusion, contract fulfillment, or for the implementation of pre-contractual measures. However, AccuAligners can only make decisions on contractual measures if you provide the required personal data for contract conclusion, contract fulfillment, or pre-contractual measures. 

Automated Decision Making

AccuAligners does not use automated decision-making or profiling according to Art. 22 GDPR.

This policy may be adapted or updated to comply with current data protection regulations. Updates ensure AccuAligners meets legal requirements and adapts to changes in its services, such as the introduction of new services. The most current version of this policy will apply to your visit.
